1. Scope
Subject to any agreements to the contrary in individual cases, contracts for a seminar, course, workshop and training, hereinafter collectively referred to as seminar, with Akademie Barth, hereinafter referred to as organizer, shall be concluded exclusively in accordance with the following conditions.
2. Registration
- By registering for the seminar, the participant or the person registering the participant accepts the terms and conditions.
- Registration for the course can be made by fax, online or by telephone to the organizer’s secretariat. A registration period of four weeks before the start of the course must be taken into account. Registrations will be considered in the order in which they are received.
- Upon confirmation of registration or invitation to the course, a legally binding contract for the course is concluded for both parties.
If a registration is made at such short notice that a written confirmation of registration or an invitation to the course is no longer possible, the contract shall be deemed to have been concluded if the registration is confirmed by the organizer in a suitable manner (e.g. by email or fax).
3. Cancellation fees
- Cancellation of registration for a course is free of charge up to four weeks before the start of the course.
- Cancellation of registration for a course up to two weeks before the start of the course is subject to a fee of 30% of the participation fee.
- Cancellation of registration for a course up to one week before the start of the course is subject to a fee of 70% of the participation fee.
- Cancellation of registration for a course at the start of the course or in the event of non-attendance is subject to a fee of 100% of the participation fee.
- The organizer will not charge the cancellation fees according to sections 3. (a) to 3. (d) if a substitute participant is provided instead.
4. Cancellation of the course
- The organizer reserves the right to cancel courses due to an insufficient number of participants or the cancellation of the lecturer. Cancellations will be communicated as soon as possible to the address or telephone number provided in the registration.
- In the event of cancellation by the organizer, the participant will be offered an alternative date as a matter of priority. If the participant does not agree to an alternative date, the participant fee already transferred will be refunded in full.
- Claims for damages of any kind due to cancellation of the course are excluded by the organizer.
5. Participation fees
- The participation fee will be shown on an invoice and is to be transferred in one installment no later than four weeks before the start of the course. This deadline must be met regardless of any third-party benefits (e.g. Federal Employment Agency).
- The participation fee always includes instruction and refreshments during breaks. Examination fees and processing fees charged by the relevant offices or authorities for issuing certificates or patents, learning materials and tests are generally charged separately, unless otherwise stated in the course description.
- If the participant falls behind with the transfer of the participation fee from the respective course invoice, the organizer can terminate the contract without notice. The organizer’s right to claim damages remains unaffected.
6. Services
- The courses are carefully prepared in terms of content and organization, so that the organizer does everything possible to ensure that the participant can achieve the course objective. The participant receives the services “from a single source” in accordance with the registration.
- The qualitative implementation of a course is facilitated by the participant carefully checking whether he or she has already gained sufficient professional experience before registering for a course.
- After a course, the participant receives a certificate with personal data in order to avoid confusion (e.g. in the case of names with the same spelling).
- The training documents provided by the organizer may not be duplicated at any time, not even after a training course.
All rights, in particular copyrights, are held by the organizer or the third parties named in the training documents. In the event of infringement, the organizer reserves the right to take legal action, e.g. to claim damages.
7. house rules
- The participant recognizes the house rules posted in the reception area as binding. Violations of the house rules constitute a breach of contract and can – after a verbal warning – lead to the termination of the contract without notice. In the case of serious violations, a prior warning is not required, e.g. smoking in the building. Should this occur, there will be no claims for compensation or repayment against the organizer.
- Anyone who does not accept the house rules must leave the organizer immediately. Should this occur, there will be no claims for compensation against the organizer.
- The respective participant will be liable for damages incurred by the organizer as a result of culpable violation or non-observance of the house rules.
8. Services not used
- The reimbursement of unused individual services is excluded and thus does not lead to a reduction of the participation fee according to registration, e.g. B. waiving an overnight stay in a hotel.
- Unused individual services also do not lead to any entitlement to replacement services, e.g. B. non-participation in class.
9. Liability
- Participation in a course as well as the use of premises and/or visits to facilities, e.g. exhibitions, shipyards, etc., organized by the organizer, are at your own risk.
- Claims for damages by the participant, for whatever legal reason, are excluded.
10. Data protection
- The participant’s data collected when registering with the organizer, such as name, address, date and place of birth or telephone number, are only recorded for the organizer’s internal purposes. The organizer expressly warrants that this data will be treated confidentially. At this point, the Data Protection Act forms the legal basis.
- The participant’s personal data will be stored by the organizer for internal processing and for the organizer’s own advertising purposes, strictly in accordance with data protection regulations. This precludes the possibility of passing on or selling the data to third-party companies without the participant’s permission.
11. Final provisions
Should any provision of these terms and conditions be invalid or contestable, the remaining provisions shall remain unaffected. The place of jurisdiction for all disputes is Duisburg.
